An Enduring Power of Attorney (EPA) is a legal document under which you appoint a trusted person/s (usually a family member or close friend) to make decisions about your property or finances on your behalf.
An EPA can be revoked at any point in time so should your relationship with a person who you have appointed as your attorney deteriorate (or you hold concerns about their ability to act in your best interests), then you can revoke their status as your attorney. The benefit of an EPA is that (unlike an ordinary power of attorney) it will continue to operate even if you lose legal capacity. An EPA does not permit your attorney to make personal, lifestyle or medical treatment decisions on your behalf. The authority of the attorney is limited to decisions about property and financial affairs.
Austral Legal’s ForwardThinker services provide fixed fee pricing for EPA’s and you may also like to consider booking our SmartMove initial 30-minute discounted consultation to discuss any queries you may have about EPA’s before making the decision as to whether or not to proceed.
