Letters of Administration

Letters of Administration

If a person has died intestate (ie without leaving a valid Will) then you may need to make an application for Letters of Administration to the Supreme Court so that you (or perhaps another family member) can then deal with the estate of the deceased person as his or her personal legal representative.

You will need to at a minimum provide the Death Certificate and ideally also provide copies of any bank statements, share certificates, super policies and so forth which relate to the assets and liabilities of the deceased person to enable the accurate completion of the required statement of assets and liabilities which forms part of the application.

Austral Legal can assist you with advice and preparation of your application and can generally do so on a fixed fee basis (typically in the range of $1,800 – $2,500) plus the Court filing fee, which at the time of writing is $370.

In the first instance you may like to meet with us in our SmartMove initial 30-minute discounted consultation for $80. Once we understand your individual circumstances, we can then likely provide advice as to what your next steps are and explain what you should expect in the application process.
