A Grant of Probate is a document issued by the WA Supreme Court which confirms an executor’s legal authority to deal with the estate and affairs of a deceased person. If for any reason the executor (as well as any substitute executor named in the Will) cannot or will not make an application for a Grant of Probate then one or more of the beneficiaries of the estate may make an application for Letters of Administration. Austral Legal can also assist with this type of application if required. Letters of Administration are also sought when a person dies intestate, which simply means that they die without leaving a valid Will.
