Restraint of trade disputes

If you are concerned about or have become involved in a dispute over a restraint of trade, then you may need to seek legal advice about the enforceability of the restraint.

If you are an employer you may want to enforce the restraint, or at least seek an acceptable negotiated outcome with the former employee. If you are a former employee, then you may want to avoid the restraint altogether. Whatever your situation is, we can ordinarily review your employment contract and promptly provide you with advice as to the enforceability of the restraint.

If it is appropriate to do so, Austral Legal can advise you about any further steps which may need to be taken. To this end we can provide as much or as little assistance as you require, from a straight-forward contract review, through to entering negotiations on your behalf or even seeking a Court order restraining the former employee.

In the first instance it is likely to be worthwhile for you to meet with us via our SmartMove initial 30-minute discounted consultation to discuss and determine the next steps (if any) in your matter.
